Terms of use

These terms apply to the Eastern Bazaar website and directory (the "bazaar") and to the online stores we host for businesses. Eastern Bazaar is operated by RM Solutions Group Inc, Stamford, Connecticut ("we", "us"). By using the bazaar or opening a store, you agree to these terms.

1. What Eastern Bazaar is

Eastern Bazaar is a directory of independent stores and a service that hosts online shops for them. We are not the seller of products in the stores. Each store is run by its own business, which sets its prices, describes its products, takes payment through its own payment account and is responsible for its orders, deliveries, refunds and customer service. A purchase is a contract between you and that store.

Some stores are fulfilled by Boomerang, a US returns and fulfilment service operated by Eastern Air Couriers, 28 West 36th Street, Room 601, New York, NY 10018, which stores, picks, packs and ships the store's stock. The store remains the seller.

2. Accounts

There are two kinds of account:

• Community members (shoppers) use the bazaar to find stores, save favourites and collect vouchers.
• Store owners open and manage one or more stores.

You must be at least 18, give accurate information and keep your sign-in secure. You are responsible for activity on your account. We may suspend accounts that break these terms.

3. Vouchers

Vouchers are offered by stores, not by us. The store sets the discount, the dates and any limits shown on the voucher, and decides whether a voucher has been validly used. Vouchers have no cash value and cannot be transferred or sold.

4. Demo stores

Stores marked "Demo store" are demonstrations. You can browse and use the cart, but checkout is simulated: no payment is taken, no order is fulfilled and no goods are shipped.

5. Terms for store owners

• Your store, your content. You own your store's content and customer relationships. You grant us a licence to host, display and back it up, and to show your store's name, description, photos and offers in the bazaar.
• What you may sell. You may sell only lawful goods and services you have the right to sell, and must follow the laws that apply to your business, including consumer, tax, product safety, food and privacy law. [Prohibited categories list.]
• Payments. You connect your own payment account (for example Stripe). Payments go to you, under your agreement with your payment provider.
• Your customers' data. Your store collects its customers' details to fulfil orders. You are responsible for that data and for your store's privacy notice; we process it on your behalf to host your store.
• Hosting. We keep your store's software updated and backed up. To keep every store secure, stores run an approved set of themes and plugins, and we may apply security updates at any time.
• Fees. Plan fees are shown when you sign up and billed in advance. If fees go unpaid we may suspend your store, then delete it after [30] days' notice. You can export your products and orders before deletion.
• Boomerang-fulfilled stores are also subject to your Boomerang agreement, which governs storage, inspection, grading and shipping of your stock.

6. Acceptable use

Do not misuse the bazaar: no unlawful, misleading or infringing content, no attempts to break or overload the service, no scraping or collecting other users' data, and no impersonation of a store or person.

7. Our liability

The bazaar is provided "as is". We work to keep it available and secure but do not promise it will be uninterrupted or error-free. We are not responsible for products, orders or disputes between shoppers and stores. To the extent the law allows, our total liability to you is limited to the fees you paid us in the 12 months before the claim, or [$100] if you paid nothing. Nothing in these terms limits liability that cannot be limited by law.

8. Changes and ending

We may change these terms; we will post the new version with its date and, for significant changes, tell store owners by email first. You can stop using the bazaar or close your store at any time.

9. Law and contact
